The trade has till the 14 of March to mount a challenge, so time is at a premium.
In Alan's own words;
"I am currently trying to raise funds for a legal challenge to this ruling.
If all those drivers affected by this were to donate £25, we would have more than enough to cover the cost".
Mr Fleming, who currently runs a legal protection scheme for drivers and owners, has informed me that Taxi Cab news and the Taxi Globe have published details of his action.

Earlier this month as an invited guest, Mr Fleming gave a rousing speech to a packed meeting of the RMT London Taxi branch. After he left, members voted to put this action to their legal department, with a view on making a legal challenge.
There are currently two companies which have viable retro-fit systems (Exhaust and electronics)
They are, Vortex performance exhausts and Cricklewood Carriers. Prices range from £500 to £1200.
Both companies are willing to front the cost for testing their systems.

ReplyDeleteWithout wanting to be pedantic, just a couple of minor points in that TfL have stated and responded to anyone that has bothered to ask that exemptions have yet to be defined rather than being ruled out as implied and exemptions for taxis affected by the age limit with existing LPG fitted or newer engines are being considered.
Oh, and that no proven systems that bring taxis to Euro V standard have been presented to and or approved by TfL but they have stated that they are happy to meet and discuss with manufacturers of such systems.
Oh and that every bus provided under contact with TfL is no older than 14 years (except those on hertiage routes) and of these a small number will be retrofitted by 2015 with Selective Catalytic Reduction equipment to ensure they meet NOx Euro IV standard rather than Euro V.
Apart from that it was spot on. Well done.Keep up the excellent high standard of reporting, you are serving your readers well!

ReplyDeleteI am willing to back Alan Fleming. There is nobody in the trade that knows Hackney Carriage case law and legislation than Mr Fleming. He has been much maligned in recent years and very much undermined.
ReplyDeleteAs an Ex-Chairman of the LCDC he is once again willing to show his metal and step up to the plate and go where his successors dare not!
Alan Fleming would never venture into such a venture if he thought losing the case was a possibility. He isn’t a hero merchant looking for glory, just one of a dying breed of cabmen that is willing to fight the injustice being levied at the London Cab Trade, and for these reasons I will gladly put my money in the pot.
After all if you received a PCN notice for an offence you know you have no chance in challenging, you would pay the fine and save yourself a lot of extra agro. So there is no real excuse for not backing this case. TfL desperately need to be challenged and Alan Fleming is the man to do it!
I think fleet owners should be made aware of alans intentions,i am sure they would willingly pay £100,peanuts compared to having their fleets decimated.I will definitely contribute as a member of the RMT & United Cabbies Group, the only ones who give a damn about the future of our trade.

I would rather stick with my present source thank you very much, as checking with TfL is like checking your facts on Wikipedia, all fairy tales and propaganda under the present regime.
I was a member of the LTDA for many years and left when I realised that they were grossly under representing the membership, I left to join the Lcdc.
ReplyDeleteFaced again with the same situation with the LCDC I will be cancelling my subscription because the club is letting the membership down through weakness.
It is taking an ex-chairman to take the fight that the inferior Grant Davis has no stomach for. I too will back Alan Fleming, because he has a record of not buckling under to pressure and is a man worth following!
Let's not forget the UTG (LTDA, LCDC & Unite) signed up for this without consulting their members.

ReplyDelete1. So the bus companies despite the billions of subsidy have until 2015 to covert the 'old timers'. Why not 2012 they have plenty of our money to do it! Lets not forget the 000's of emepty buses trundling along Oxford Street or driving around the city during the night as the bus garages are full!
2. Your comment about LPG Cabs & Euro V conversions just exhibits that you have rushed out a decision without thinking about it. How unusual!!!!
3. No doubt the ' UTG yes men' you meet with did not even mention the issues we have raised on here,
Still once the minutes are published we can all tell who said what to whom. (p.s. don't write them now, we had a 'mole' present and they will comment on the accuracy).
4. You fail to mention the zero emmissions zone proposed and how that impacts on us or give details of any undertaking to the licensee that the limit will not change, so the part time/semi retired driver could buy an 11 year old cab to 'see them out' and you move the goalposts to 10 or 12 years very soon afterwards
5. Notwithstanding any of the above neither the Mayor, his hyper active spokesman Ranger, Hendy (anyone who disagrees is a 'militant')or LTPH can credibly explain what the emissions difference is of a cab 15 Year Old or a TX4 on 01.01.2012 will be:
a) They have both passed the same smoke test.
b) The TX4 pays double the road tax due to EMISSION PRODUCED. How strange.
Another ill conceived, politically motivated stunt from Boris Johnson endorsed by those who no longer enjoy any credibilty and it will do NOTHING to improve London's Air Quality.
Euro V for us, Euro 4 for PHV's!!!
Where do I make that donation to Boris's election fund?

I Will be contributing to Alan Flemings fighting fund.But my question is,If the case was taken court over the 10yr age limit,and the court decided you cant set a age limit,Then surely a precedent has been set,So obviously if we need a fighting fund,Surely it must cost TFL and City Hall,money to got to court as well.Unless BORIS is going to pay this out of his own pocket then it must follow he will be using public funds,So in fact we will be paying for both sides,eiher via our council tax or our Income Tax,Now in the time of Goverment cuts,this seems to be an abuse of Public Funds,and something the voting public should be made aware of,As this wont be the first time our money has been used to back the Mayors whim,Remember Livingstone and the Nazi,comments.

ReplyDeletethe reason you don't know of any retro exhaust kits is...you haven't bother to find out. Just like you see no touts in lines of PHVs ranked outside clubs. You only see what you are told to see by Hendy.
Buses to be retro fitted at our expense, not the bus companies and to only Euro IV, smacks of goal posts being moved. most Taxi drivers find this an insult...
Figures for this post and the post on Taxi Leaks were freely given to Mike Robinson by no other than John Mason, in reply to a communication sent by Mr Robinson.
I would suggest that you do more research before criticising the work of others.
TfL are on dodgy ground with this issue and they know it. They will more than likely lose more of their budget with a court case.
Perhaps they will have to go without flowers on the 14 floor after all.
