Over the next couple of weeks you will see the United Trade Group, slapping backs and claiming victory for securing a 15 year age limit for the life span of a working Taxi in London. An age limit that should never have been offered in the first place.
You will not read what this group has agreed to, on your behalf, behind closed doors to achieve this hollow victory.
Top brass at TfL from Peter Hendy down to John Mason, have been extremely embarrassed by an apparent 54% escalation in serious sexual assaults including rapes, while detection and conviction rates have fallen by 50% to an all time low (3 convictions in 2009).
This is based on figures TfL themselves have supplied. Other sources have shown an even greater increase. See the badge issue 184 page 10. In the Daily Mail’s article, a high court judge gave the figures of 214 sexual assaults with 54 rapes, almost double the figures issued by TfL.
Even more alarming are figures supplied by the NHS Haven crisis centres, who say rapes alone are in treble figures as most are not reported to the police.
It is generally believed by many in our trade and those in the field of enforcement, that this is a direct consequence of the relaxation of minicab booking requirements and the easy set for Satellite Offices. We have seen TfL issue Satellite office licenses to no more than a flashing light place on a wall with a clipboard Johnny standing underneath.
Joe Royal spoke at an AGM of the LCDC saying that in his opinion, the current legislation at satellite offices was unenforceable. Nothing has ever come of this statement, which was completely ignored by the UTG (Surprise, Surprise). Even a casual observer can ascertain that there is a serious problem with the standard of enforcement from the Met Police and PCO cab enforcement at certain places within central London.
Back in November, evidence was provided by a Unite Cab section member, published on the CTN blog and echoed on the LCDC blog, that showed satellite offices were always intended to be implemented by design, despite John Masons insistence that Satellite offices never existed.
So, what has the UTG done with the evidence given to Unites General Secretary (Cab Section) Peter J Rose by the Unite member?
Peter published the article on the Cab Trade News Blog.
But then Peter was mysteriously removed from his seat at the UTG negotiating table and replace by Jim Kelly.
Next the author of the LCDC blog suddenly disappeared from the media spotlight !!! it is also alleged that all prominent members of the UTG have been warned to stay off Twitter and internet forums.
The evidence published on the CTN web blog in a power point presentation, proves beyond a shadow of doubt that their has always been an agenda to set up SATELLITE offices, with lines of waiting minicabs illegally plying for hire outside. The whole idea was designed by Geoffrey Riesel and Peter Hulme Cross, on behalf of the then Mayor, Ken Livingstone.
Ken made no secrete of the fact that he intended to let Private hire vehicles ply for hire between the hours of 10pm until 6am.
We know from documents published on the TfL web site (Now sadly removed, although we have hard copies) that a Gold silver and bronze system was to be trialled for private hire where Gold service drivers would be allowed to use existing Taxi ranks along with licensed taxis.
Ken was then deposed by Boris, but his personal agenda has been secretly adhered to by faithful followers at TfL, behind the new Mayors back.
Unites Jim Kelly has thrown the weight of Unites cab section, behind the idea of putting the man that so nearly destroyed the Licensed Taxi Trade, back into office.
Peter J Rose, has been accused of printing the untrue, something that LCDC Chairman grant Davis frowns heavily upon.
If that’s the case Mr Davis then why print in Novembers Badge that over a weekend 40 Yellow badges were caught either plying for hire or had jobs on board picked up out of sector?
We challenge the LCDC to show us the evidence as we have enquired and been informed by a Superintendent of the COL Police that this is indeed not the case and is a fabrication. We have also checked the Court records for upcoming cases (available on line) and there are none involving Licensed Taxi drivers (Suburban) working out of sector.
Was this exaggeration made as a favour, to give credibility to John Masons Green and Yellow ID stickers?
Now back to the main thread!
Why has the evidence, (which was reported on the CTN blog and the LCDC blog) been buried?
Why has this evidence failed to show up in trade media such as Taxi the Badge, or even the Cab Trade News?
Have the UTG agreed to play down this issue in exchange for an illegal 15 year age limit that nobody wanted in the first place?

I would like to inform you and your readers that it is unlawful to place an age limit on any motor vehicle.
Back in the late seventies the age limit on a cab in London was ten years. However, a cabbie took the PCO to court on the matter, and the case finnished up before the Law lords.
They made the following judgement. So long as a motor vehicle complies with its construction and use regulations at the time of first registration and is safe for the road, an age limit cannot be placed on any motor
vehicle.
What TFL are proposing is unlawful.

Tells prominent UTG members to avoid awkward questions by staying off Twitter and the internet.
BTW, M&O's was invited to be part of the offer made by the UTG plus interested parties, but the RMT who say an age limit is wrong, was not invited.
Mr Flemings case law has been well documented over the years.
Put yourself out and dig it up with a bit of research or better still phone him and he will tell you.

ReplyDeleteAnonymous, difference between a statement made by Alan Fleming and team TfL (John Mason and Luke Howard) is Alan can and will back up statements with case Law. For months Luke Howard used James Buttons book, as reference to legality of PH ranking outside venues, until Buttons made a clear statement that PH can not stand and wait to be hired. Now they are bluffing their way. Take them to court and they will fold like a pack of cards.

This looks like a trade off by the UTG for concessions,beacause of the exposed hidden agenda behind STaN! If a deal has been stuck outside of the consultation, where does this leave J.Mason, TFL, The Private Hire Industry and the consultation itself?
If this revelation proves to be true this is not just underhand and sly, but also corrupt! and I wouldn't be surprised if TFL find themselves in court!

This time the trade off is a 15 year limit, as opposed to the 10 requested, on London's roads, in exchange for NOT mentioning the satellite offices. More like "DONT MENTION THE WAR" from Fawlty Towers, only this time you could not make it up. There is no such thing as a free lunch, and quid pro quo, the piper must be payed.
ReplyDeleteIt started back in the late 80s or early 90s, when suddenly we were told that we could have advertising on our cab doors, and a new order was rushed through allowing us to continue using the royal parks because of the advertising. For allowing us to get paid as well, the licence fee rose from 15p to £75.00. and still rising.
Who amongst you remembers the extras we were allowed to charge for luggage and extra passengers? These were traded away for rates 1,2, and 3,not forgetting the 6 mile limit was doubled to 12. Hey, when the time comes, let's vote Ken back again.(I think not)
And how is it, that we,voted the best cab trade in the world, are now in the minority by 3 to 1? What are they doing with that extra revenue at Palestra House? I understand that a yellow badge driver, at 3am, picking up at victoria station is a heinous crime,but what of the touts nightly in the centre of town. Why is it that the PCOs can and will nick the cab driver, but only the police can nick a scab for touting?
Let's take a leaf out of the students book, and demonstrate weekly, but without the violence. I know that this month we all need to take as much as possible, and dont want to give up preciouse time when money is to be had, but January is close by, and the work will be thin on the ground then. This will be a good time, with no excuse, to start the demos. And why stop at only one location at a time, when there are several places with roundabouts that wont take too long to clog up, as well as not just one day occasionally. How about one day the first week, followed by rwo days the following week,and so on?

ReplyDeleteWe surrendered what we had (a condition based age limit) to an arbritary 15 Years with two MOT's (special Taxi one's at what cost?) to boot.
Quite how that solves the soot clouds from TX2's as soon as you boot them is a mystery or how it improves the air quality considering the buses and congestion levels is beyond me.
No doubt the Badge, TAXI and CTN will try and portray this defeat as a victory.
Still there is always the Yellow Badge 'Menace' to really get your teeth into Mr. Grant Davis & Co.
As for court action, just wait and see.

Jim Kelly has made a statement via the Cab Trade News blog claiming UNITE has secured a victory for the cab trade by closing a deal that includes: A rank outside Abacus in the City, a fifteen year life span for London Taxis and a ban on Private Hire having blacked out windows on their vehicles! All on the strength of a photo shoot at DaC house that the LCDC refused to attend and document that was drawn up by the LTDA.

The LCDC did nothing other than sign the LTDA document, Jim Kelly had nothing to do with the negotiations and his lack of involvement with UNITE'S cab section was brought up at a recent monthly meeting in an attempt to undermine Jim Kelly by persons with ideas way above their capabilities !
So word of warning to Jim Kelly, there are those among UNITE conspiring to make moves to depose you!
So how can the LCDC claim an UTG victory ?
This whole fiasco and deal was done on the back of the work done by a UNITE activist and researcher exposing the secret agenda behind STaN. The claims of the UTG are totally bogus !
I think John Griffen may have something to say about This sly deal for silence cut outside of the Private Hire consultation. Now this guy does have the money to take TfL to court !
Absolutely, the United Trade Group certainly do have more lies than the rest put together, and nothing to offer the trade regarding a strategy for the future of our trade, short of total surender to John Mason and the TfL agenda to put mini-cabs everywhere .....The trade organisations are a total disgrace !

John Mason has all but achieved his goal. He has neutralised what he perceived as the players in the cab trade and will almost definitely move up the greasy pole to another position !
ReplyDeleteThe players within our trade organisations capitulated very quickly to John Mason, mainly because they have failed at all attempts in the past to stamp their authority on the trade. They have ridden on the backs of cab men that preceded them, but never really achieved anything themselves. Our trade leaders are spent of any ideas and have no idea how to move our industry into the future. They are failures!
Peter Da Costa runs a multi million pound franchise. He with the other, so called major players in our industry delivered a document laying out to TfL what our bottom line was before ANY negotiations took place!
Think about it? Wouldn't Peter Da Costa love it if every cab driver walked through his door at KPM and told him straight up what the minimum they would accept for their cab, before he said a word ? This is the worst piece of negotiating I have ever seen....DISGRACEFUL!

After reading John Masons letter concerning members of his staff being enlightened at a recent demo what they are involved with at Palestra. I am convinced more that ever that the rape issue and STaN gate affair is something TfL cant find a shovel big enough to bury.
